These data showed that Black Veterans were statistically less prone to be granted an application for disability than white veterans between 2001 and 2020. This "bad paper" did not allow him to get the home loan, tuition assistance and other benefits.

He sued the military to revers the discharge and was awarded full benefits both in 2015 and 2020. However, he claims the VA still owes him money due to his past denials of disability compensation. The suit claims that he also was emotionally damaged by the repetition of his most traumatic experiences with each application for benefits.

The lawsuit seeks financial compensation and also asks the court to order the VA to review its systemic PTSD discrimination. This is the latest initiative by groups such as the ACLU and Service Women's Action Network to force the VA to address the long-running discrimination against victims of sexual assault.
